11a – REFUNDS – ENTRANT DECISION. Entry fees are in principle nonrefundable should an entrant withdraw prior to the event. However, the
organisers will review refund requests in certain circumstances on an en�rely
“discre�onary” and “without precedent” basis. Requests for refunds in the 2
weeks prior to the event are unlikely to be considered in any circumstance
(no�ng that suits and packs by this �me will have been largely packed and
distributed - and cannot therefore be reassigned).
11b – CANCELLATION – ORGANISER DISCRETION. If the organisers decide –
in the weeks or months before the event date (and before Santa Suits have
been distributed to entrants) that the event is not viable (perhaps through
insu昀케cient entries, or problems with the necessary permissions) they may
decide to cancel the Fun Run. The organisers shall not be liable for any
losses incurred by a par�cipant as a result of cancella�on of the event,
except that lead par�cipants will be given a refund of the entry fee within 30
(thirty) days from receipt of no�昀椀ca�on by email to par�cipants.
11c – CANCELLATION – FORCE MAJEURE. In the unlikely event of late and
unexpected eventuali�es a “Force Majeure” might arise. In this situa�on the
organisers might - at very late no�ce - decide to cancel the event in the interests of
entrant safety. (The organisers may also - at late no�ce - change or shorten the
published route for reasons of safety). If a cancella�on decision is made very
signi昀椀cant and uncovered costs will have been incurred and the charitable nature
of the event will have been largely nulli昀椀ed. Costs include all those related to event
prepara�on, and of course most Santa Suits will have already been despatched.
(Because of the voluntary nature of the event there would be no prac�cal facility
for the return of suits). However the organisers will o昀昀er, on a purely discre�onary
basis, lead entrants the opportunity to reclaim up to 50% of the entrance payments
as a gesture of goodwill – the o昀昀er being made by email to the lead entrants. Lead
Entrants may of course decide not to seek this reimbursement in order to enable
the various selected chari�es to bene昀椀t. The mechanism to enable this refund
would be that lead entrants are no�昀椀ed by email of the o昀昀er within 14 (fourteen)
days of the event date, and that reimbursement is made within 30 (thirty) days of
